An Introduction to Brundeanlaws Woodland

Located just outside the former royal burgh of Jedburgh, Brundeanlaws Woodland is a first-rate opportunity to acquire a high-quality young compact conifer woodlands in a beautiful part of southeast Scotland.

Location and Directions

The woodlands are situated approximately 10 miles southeast of Jedburgh in the Scottish Borders. From Jedburgh, take the A68 south for approximately 7 miles then take the left-hand turn onto the minor road signposted Edgerston Tofts/Hownam/Hindhope. Follow this road for approximately 2.2 miles after which turn left into the forest entrance (Point A1 on the sale plan).

Description

Brundeanlaws is a highly productive commercial conifer woodland which has been restructured over the last 6 years with young second rotation crops. It currently comprises mostly Sitka spruce with some Norway spruce, areas of native broadleaves, and ground awaiting replanting. With all first rotation crops to be felled at the point of sale the earliest commercial conifer planting is 2019 with more recent planting in 2024. The productive area of the woodland accounts for 84% of the property with the 27.03ha felled over land having approval for replanting with predominantly Sitka spruce along with Norway spruce and native broadleaves.

Brundeanlaws benefits from approximately 1,000m of internal forest road suitable for timber haulage.

Harvesting of the 27.03 ha mature crops in compartment 3 in the south of the property is currently underway and all timber will be removed prior to a purchaser taking entry. The property will be sold with a restocking obligation over this area. Details are available from the Selling Agent.

Wayleaves, Third-Party Rights and Burdens

The property will be sold subject to and with the benefit of all servitude rights, burdens, reservations and any other third-party rights howsoever constituted.

There is a servitude right of pedestrian and vehicular access to and egress from the neighbouring property of Edgerston Tofts over the existing internal forest access track traversing Brundeanlaws Forest from Point A1 to A2 with maintenance on a user basis.

Fencing obligations are understood to be (as letter on sale map):

• Between A – B, the fence is to be maintained solely by the neighbouring owner of the land to the north west.

• Between B – C, the fence is to be maintained solely by the owner of Brundeanlaws.

• The northern and eastern boundary are to be jointly maintained with the neighbour.

Sporting

The sporting rights are included insofar as they are owned.

Access

The C33 public road borders the southern boundary of the property. From Point A1 there is a stoned forest road along the boundary between compartments 2 and 3 with a spur road northeast into the property providing access to compartment 1.

The C33 is a Consultation Route as designated by the Timber Transport Forum and is a well-tested route for timber haulage having been used frequently in recent years including for the current harvesting operation at Brundeanlaws.

The forest is open to access with no locked gates.

Minerals

Mineral rights are included except as reserved by Statute or in terms of the title.

Plans, Areas and Schedules

Parts of the woodlands are bounded by fencing and stone walls, which are predominantly maintained to a stockproof standard where necessary, with maintenance of existing fences to continue as described above and in terms of title. The fences around the property may not be located on the boundary of the registered title. Where these are set back within the title to be sold, warrandice will not be granted over any unfenced areas. These are based on the Ordnance Survey and are for reference only. While they have been carefully checked, the purchaser shall be deemed to have satisfied themself as to the description of the property and any error or misstatement shall not annul the sale nor entitle either party to compensation in respect thereof. Viewing

Strictly by prior agreement with the selling agents who should be contacted in advance to advise on access arrangements. For the personal safety of interested parties, please be aware of potential hazards at the property. As a result of the ongoing timber harvesting and extraction, the internal forest road (A1- A2) will be in frequent use and so visitors are requested to please wear appropriate high visibility clothing and avoid the timber harvesting operations during your visit, observing all signs and guidance provided.

Please ensure good forest hygiene measures are followed, such as cleaning boots, equipment, vehicles and machinery, which will help protect woodlands from potentially damaging pests and diseases.

Closing Date

A closing date may be fixed, and prospective purchasers are advised to formally register their interest through their solicitors with the selling agents. Prospective purchasers should be aware that unless their interest in the property is formally noted, no guarantee can be given that confirmation of a closing date will be provided, consequently the property may be sold without prior notice. For the avoidance of doubt, noting interest only entitles prospective purchasers to notification of a closing date being set and not that other potentially competing pre-emptive offers have been received. The sellers are entitled to accept any offer at any time.
